: Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India to issue a Writ of Mandamus, directing the respondents not to waste the water available in the tank situated in S.No.239, Koodalur Village, R.S.Mangalam Taluk, Ramanathapuram District, which can be utilized for cultivation and harvesting by the Agriculturists during this year i.e., till the end of November, 2020 and meanwhile in the name of renovation of the tank, the water available in the tank should not be wasted and the tank can be renovated after November, 2020, i.e., after the harvest is over. ******* [Order of the Court was made by P.N.PRAKASH, J.] The petitioner has filed the present Writ Petition seeking a direction to the respondents not to waste the water available in the tank situated in S.No.239, Koodalur Village, R.S.Mangalam Taluk, Ramanathapuram District, which can be utilized for cultivation and harvesting by the Agriculturists during this year i.e., till the end of November, 2020 and meanwhile in the name of renovation of the tank, the water available in the tank should not be wasted and the tank can be renovated after November, 2020, i.e., after the harvest https://hcservices.ecourts.gov.in/hcservices/ 1/2

2. It is the allegation of the petitioner that the respondents 1 and 2 have allotted Kudimaramathu work in respect of the tank situated in Survey No.239, Koodalur Village, to the third respondent and that the third respondent is attempting to completely drain the tank of all the water.

3. Per contra, on instructions, Mr.R.Sethuraman, learned Special Government Pleader appearing for the respondents 1 and 2 submitted that there is only 10% water available in the tank and that also is not being drained out.

4. Recording the aforesaid submission made by the learned Special Government Pleader for the respondents 1 and 2, this Writ Petition is closed, however, with a direction to the Tahsildar, R.S.Mangalam Taluk, Ramanathapuram District, to monitor the works and ensure that the work is being carried out properly. No costs. Consequently, the connected miscellaneous petition is closed.
