ORDER

This revision case has been filed to set aside the order passed in Na.Ka.No.A3/2366/2020 dated 21.05.2020, on the file of the 1st respondent.

2.On the side of the petitioner, it is stated that the petitioner is in custody on the basis of the detention order passed by the first respondent. No show cause notice was issued or no enquiry was conducted and prays the petitioner to be released. 3.On the side of the prosecution, it is stated that the petitioner is a habitual offender and he is having two previous cases in Crime Nos.641 of 2010 and 24 of 2015. The petitioner has violated the condition of the bond and objected the release of petitioner.

Crl. R.C.(MD)No.377 of 2020 4.A perusal of the records reveals that the petitioner is in custody from 21.05.2020. A perusal of the detention order reveals that no show cause notice was issued and no enquiry was conducted. 5.In view of the above, the Criminal Revision Case is allowed and the order passed in Na.Ka.No.A3/2366/2020 dated 21.05.2020, on the file of the on the file of the 1st respondent is hereby set aside. No Costs. Consequently, connected miscellaneous petition is closed.
