Respondents Prayer : Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of declaration, to declare the selection and appointment of third respondent as Anganvadi Assistant in Maravapatti Anganvadi Centre in Kallikudi Union, Madurai District is illegal and consequently directing the respondents 1 and 2 to appoint the petitioner as Anganvadi Assistant in Maravapatti Village at Kallikudi Union, Madurai District.

ORDER

The petitioner is a candidate for the post of Anganvadi Assistant, Maravapatti Anganvadi Centre, Thirumangalam Taluk. Instead of the petitioner, the third respondent was selected. 2.The event pertains to the year 2012. This Court called upon the official respondents to answer as to why the petitioner was denied employment and instead the third respondent was chosen. When the records were perused, it was seen that the petitioner was awarded more marks by applying standard parameters like age, residence and educational qualifications. But, it is seen that the petitioner is suffering from 40% disability. The post of Anganvadi Assistants requires that the appointee must be able to https://hcservices.ecourts.gov.in/hcservices/

lift the children and also be physically capable. 3.Considering the nature of disability the petitioner is suffering from, the authorities came to the conclusion that the petitioner will not be suitable to hold the said post. That is why even though the petitioner was given good marks, she was denied employment. The action of the authorities is perfectly reasonable.

4.In this view of this matter, this writ petition stands dismissed. No costs.
