ORDER : The Court Made the following order :- The petitioner is arrayed as sole accused, who was arrested and remanded to judicial custody on 16.09.2016 for the alleged offences punishable under Section 8(c) r/w 20(b)(ii)(B) of NDPS Act, in Crime No.866 of 2016 on the file of the respondent police and hence, seeks bail.

2.The case of the prosecution is that when the respondent Police conducted raid, they found that the petitioner was in possession of 1.250 kgs of ganja.

3.The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. The petitioner is in judicial custody from 16.09.2016.

4.The learned Government Advocate (Crl. side) submitted that the petitioner is a habitual offender and he is having three previous cases and investigation is pending.

5.Considering the serious nature of allegations levelled against the petitioner, this Court is not inclined to enlarge the petitioner on bail. Accordingly, this Criminal Original Petition is dismissed.
