Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner apprehends arrest at the hands of the respondent police for the alleged offences under Section 430 IPC and Section 3 of the Tamil Nadu Property (Prevention of Damage and Loss) Act, 1992 and Section 21(4) of the Mines and Minerals (Development and Regulation) Act, 1957, in Crime No.85 of 2018 and seeks anticipatory bail.

2.The allegation against the petitioner is that he was involved in transportation of one unit of sand illegally. 3.The learned counsel for the petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. 4.The learned Government Advocate (Criminal side) submitted that the petitioner is involved in transporting one unit of sand illegally. He further submitted that there is no previous case against the petitioner herein.

5.Considering the facts and circumstances of the case, this Court is inclined to grant the relief of anticipatory bail to the petitioner.

6.Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Magistrate concerned within a period of 10 days from the date of receipt of a copy of this order, on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Devakottai, or to the satisfaction of the respondent police or the police officer who intends to arrest and on further condition that the petitioner shall appear before the respondent police daily at 10.30 a.m. for two weeks and thereafter, as and when required for interrogation.
