ORDER
The present Writ Petition has been filed for the issuance of a Writ of Certiorari, to quash the impugned Tender Notice dated 07.03.2025 issued by the 1st respondent.
2. The challenge in the present writ petition pertains to the Tender Notice referenced as Tender No. NHAI/17011/01/121/2025/RO Madurai, dated 07.03.2025. The tender was issued since the agreement between the petitioner and the respondents were terminated.
3. It is submitted by the parties that during the pendency of the writ petition, tripartite agreement was entered among the petitioner, NHAI and the Highways Department. Based on the same the petitioner submitted that the impugned tender notice ought to be set aside. However, the respondents submitted that the prayer sought by the petitioner in this writ petition has become infructuous in light of the tripartite agreement. 2/5
4. Considering the facts of the case, this Court is of the considered opinion that the earlier agreement has been replaced by the tripartite agreement. Therefore, the tender notice cannot be proceeded with. Consequently the same is quashed.
