ORDER

The petitioner filed W.P.(MD)No.7340 of 2025 challenging the termination notice dated 06.03.2025, by which the maintenance agreement was terminated. This Court, while disposing of the said writ petition, held that in view of Clause 23.6.2 of the agreement, it was for the contractor and the first respondent to work out their respective remedies, and that the writ court could not interfere in the matter.

2. In the present writ petition, the petitioner has challenged the subsequent tender notification on the ground that a fresh tender could not be issued while the earlier contract was still in force. However, the earlier order of this Court has already affirmed the validity of the termination. It is also brought to the notice of this Court that the tender process had lapsed owing to the interim order passed by this Court, and that a fresh tender is now proposed to be conducted.

3. In view of the above developments, the relief sought in this writ petition has become infructuous. Accordingly, this writ petition is dismissed as infructuous. No costs. Consequently, the connected miscellaneous petitions are closed.
