O R D E R
The present writ petition has been filed to quash the order passed by the third respondent in O.Mu.No.3576/A1/2021 dated 09.02.2022, wherein the request of the petitioner to approve him as Secretary of the Thirugnanasampanthar Middle School, Puliyankudi, has been rejected.
2. A perusal of the order impugned in this writ petition reveals that three proceedings are pending before the court, namely, W.P.(MD)No.15831 of 2021 before this High Court, S.L.P. (C).No.30848 of 2016 before the Hon'ble Supreme Court and another writ petition in W.P.(MD) No.15398 of 2/5
2020 before this Court. Therefore, the request of the petitioner to approve his secretaryship cannot be considered.
3. The learned Senior Counsel for the petitioner points out that S.L.P. (C) No.30848 of 2016 was disposed of by the Hon'ble Supreme Court on 01.05.2023. He further submits that W.P.No.15398 of 2020 has also been disposed of on 05.10.2023. According to him, W.P.(MD)No.15831 of 2021 has also been disposed of. Therefore, there is no legal impediment as on date to consider his representation to approve his secretaryship.
4. The learned counsel appearing for the fourth respondent submits that in case any fresh proposal is submitted by the writ petitioner to the third respondent, his objections may be considered.
5. In view of the abovesaid facts, the order impugned in this writ petition is set aside and the matter is remanded back to the file of the third respondent. The petitioner is at liberty to submit a fresh proposal to the third respondent seeking approval for the secretaryship. In case any such application/proposal is received, the third respondent is directed to hear the 3/5
objections raised by the fourth respondent herein and pass orders on merits and in accordance with law.
