PRAYER :- For Bail in Crime No.76 of 2021 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner/A1, who was arrested on 17.03.2021 for the offences punishable under Sections 379 of IPC r/w.Section 21(1) of Mines and Minerals (Development and Regulation) Act, 1957 in Crime No.76 of 2021 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner along with other accused said to have illegally transported 1⁄4 unit of river sand in five bullock carts. Hence the complaint.

3. The learned counsel for the petitioner would submit that the petitioner is innocent and a false case has been foisted against him. He would also submit that the petitioner is in jail from 17.03.2021, hence he seeks bail.

4. The learned Government Advocate(Crl.Side) would submit that the petitioner is a having three previous cases of similar nature. 5.Taking into consideration the facts and circumstances of the case and also taking into consideration the previous three cases of similar nature, this Court is not inclined to grant bail to the petitioner.
