ORDER : The Court made the following order :- The petitioner, who was arrested and remanded to judicial custody on 10.06.2023 for the offences punishable under Sections 8(C), 20(b)(ii)(C), 25, 29(1) of NDPS Act, in Crime No.374 of 2023 on the file of the respondent 1/5
police, seeks bail.
2.The case of the prosecution is that on 09.05.2023 at about 17:15 hours, on the basis of secret information received, the respondent police conducted a vehicle check-up on Tuticorin Ring Road near Hanna Joseph Hospital. At that time, they found one Rajkumar in possession of 40 kg of contraband. On his confession, the petitioner, along with other accused persons, was implicated, and a total of 2050 kg of contraband was recovered from them. Hence, the case has been registered.
3. The learned counsel appearing for the petitioner would submit that the petitioner is an innocent and he has not involved in any offence as alleged in the FIR. Only based on the confession of the co-accused, the petitioner was falsely implicated in this case. Investigation has been completed and final report also filed before the special Court and the trial commenced. The petitioner is in judicial custody for more than 2 years and 8 months. Therefore, prayed to grant bail for the petitioner.
4. The learned Additional Public Prosecutor appearing for the respondent submitted that the offence is grave in nature and that there are totally 15 2/5
accused in this case. The quantity involved is a huge commercial quantity. Though the petitioner is a native of Tamil Nadu, he has settled in Odisha. The investigation has been completed and the final report has been filed. The case is now pending and posted for examination of witnesses before the Special Court for Trial of Narcotic Drugs and Psychotropic Substances Act Cases, Madurai, in C.C. No.256 of 2024 and no one was granted bail in this case. The case has been split up in respect of A14 and A15. Further, the petitioner has 7 previous cases. Therefore, he strongly opposed the grant of bail to the petitioner.
5. This Court heard both sides and perused the materials available on record.

Considering the rival submissions made by the learned counsel on either side, considering that the quantity of contraband involved in this case is a huge commercial quantity, that the investigation has been completed and the case is posted for examination of witnesses, and that the petitioner has more previous cases of a similar kind of offences, and considering the heinous nature of the offence, this Court declines to grant bail to the petitioner at this stage. 3/5
7.Accordingly, this criminal original petition stands dismissed. However, considering the long pendency of the case, the learned Special Judge, Special Court for Trial of Narcotic Drugs and Psychotropic Substances Act Cases, Madurai, is directed to expedite the trial proceedings, without granting any long adjournment beyond one week and dispose of the case in accordance with law.
