(Order of the Court was made by N.SATHISH KUMAR, J.) Challenging the order of the learned Single Judge of this Court dated 09.01.2026 made in W.P.(MD)No.21078 of 2024, the present writ appeal is filed.
2.It is the contention of the appellant that he was eligible to be appointed to the post of Secondary Grade Teacher and also B.T. Assistant Teacher. Originally, the posts of Secondary Grade Teacher and BT Assistant were filled up based upon the weightage marks that are given to the candidate on the basis of their experience, apart from the marks that have been obtained in the Teachers' Eligibility Test. However, by virtue of G.O.Ms. No. 49, School Education Department, dated 2/7
20.07.2018, the method of recruitment to the aforesaid posts was altered by introducing a written competitive examination among the candidates. 3.According to the appellant, for the year 2014, the appellant had participated and was placed as the next immediate candidate for selection to the post of Secondary Grade Teacher. If the same method is continued, the petitioner would have been selected during the next recruitment. However, due to change in the recruitment policy, the writ petitioner has lost his opportunity.
4.In such circumstances, the appellant seeks a direction to appoint him to the post of Secondary Grade Teacher. In support of his claim, he has placed reliance on the judgment of the Division Bench in W.P. Nos. 26084 of 2023 etc., batch, dated 10.07.2024, wherein the Division Bench directed the State Government to continue the process of appointment that had been left midway in the year 2017. Placing reliance on the said judgment, the petitioner seeks similar relief. 5.The method of recruitment to the post of Secondary Grade Teacher and B.T.Assistant came to be modified by issuance of 3/7
Government Order in G.O.Ms.No.149, School Education Department dated 20.07.2018. Pursuant to the same, the Government had issued a notification on 09.02.2024, for direct recruitment of the Secondary Grade Teachers for the year 2024 as per the vacancies notified by the Department 6.The learned Single Judge after noting the fact that neither the Government Order in G.O.Ms.No.149 dated 20.07.2018 nor the notification issued in the year 2024 for selection of the candidate through the competent written examination stand challenged, held that the petitioner having failed to come within the zone of consideration for appointment, the writ petitioner is not entitled for appointment. 7.We have perused the entire materials placed on record. 8.Perusal of the order passed by the Division Bench in W.P.Nos.26084 of 2023 etc., batch shows that the Division Bench has directed the Government to continue the process of appointment that was left midway in the year 2017. The said decision does not come to the aid of the appellant herein.

9.The appellant has not even participated in the subsequent notification issued in the year 2024. It is stated that the petitioner had qualified in the Teachers' Eligibility Test in the year 2013 and had participated in the recruitment process for the year 2014. However, much water has flowed since then. The Government has, in the meanwhile, issued G.O.Ms.No.149 and also notified a fresh recruitment process in the year 2024. Having remained a mute spectator, the petitioner cannot, as a matter of right, claim appointment merely on the basis of his participation in the earlier selection process in the year 2014. 10.In the light of the above observations, we find no merits in this writ appeal. Accordingly, the writ appeal stands dismissed. There shall be no order as to costs.
