Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Certiorarified Mandamus to call for the records pertaining to the Impugned Order in R.No.22997/E5/A3/2021, dated 26.03.2021 on the file of the Respondent No.2 and quash the same as illegal and consequently for a direction, directing the Respondent No.2 to issue appointment orders for the post of Assistant Surgeon (General) to the petitioners in pursuant to the Notification No.07/MRB/2018 issued by the Respondent No.3, dated 12.01.2021 within the time period stipulated by this Court.

ORDER

This Writ Petition is filed to call for the records pertaining to the Impugned Order in R.No.22997/E5/A3/2021, dated 26.03.2021, on the file of the second respondent and quash the same 1/3

as illegal and consequential direction to the second respondent to issue appointment orders for the post of Assistant Surgeon (General) to the petitioners in pursuant to the Notification No.07/MRB/2018, dated 12.01.2021 issued by the third respondent, within the time period to be stipulated by this Court.

2.The present writ petition is filed to challenge the impugned order in R.No.22997/E5/A3/2021, dated 26.03.2021, issued by the second respondent and give appointment to the petitioners as and when the vacancies arise.

3. When the matter is taken up for hearing, the learned Special Government Pleader appearing for the respondents submitted that subsequent to the filing of the writ petition, the petitioners were given appointment and issued with a separate appointment and posting orders, by the proceedings, dated 21.04.2021 and hence, the relief sought for in the writ petition has become infructuous.

4. Recording the above submission, this writ petition is dismissed as infructuous. No costs. Consequently, connected miscellaneous petition is closed.
