O R D E R

This Court perused the entire materials on record and it is noticed that the order passed by the Controlling Authority under the Payment of Gratuity Act, 1972 vide Na.Ka.No.965/2020/KiVeeTi, dated 08.01.2021, has not been challenged by filing an appeal under Sub-Section (7) of Section 7 of the Payment of Gratuity Act, 1972. However, the respondent No.1 - writ petitioner, while challenging the notice issued by the respondent No.2 herein, under the Revenue Recovery Act, sought for a consequential relief to quash the said order dated 08.01.2021. In the considered 1/3

prima facie view of this Court, no relief can be granted as against the order dated 08.01.2021, passed by the Controlling Authority.

2. In the circumstances, pending further orders, the petitioner herein is permitted to withdraw the amount of Rs.50,000/- (Rupees fifth thousand only) deposited before the respondent No.3 herein pursuant to the interim order dated 06.07.2021, passed by this Court.
