O R D E R

The prayer in the writ petition is to issue a Writ of Mandamus directing the respondents to permit the petitioner to fly abroad to Foreign country of Saudi Arabia.

2.According to the petitioner, he had been working as a Valve Technician in Saudi Arabia and returned to his native town at Rajapalayam in February 2018, in order to be with his family members. On 30.04.2018, there was a quarrel between two communities in the village during the festival of Periya Mariamman Kovil. In https://hcservices.ecourts.gov.in/hcservices/

this connection, an FIR was registered and the petitioner was also arrayed as accused in the FIR.

3.According to the petitioner, in view of the registration of FIR, he is having valid apprehension that he may not be allowed to go back to Saudi Arabia to join his duty. However, from the averments and the materials disclosed, this Court does not see any cause of action for the petitioner to approach this Court on the basis of mere apprehension.

4.This Court cannot act on the basis of such imaginary apprehension expressed by the petitioner while exercising its extraordinary jurisdiction under Article 226 of the Constitution of India.

5.For the above reasons, this Court is of the view that the present writ petition is pre-mature and the same is dismissed. No costs.
