ORDER

The petitioner, seeking free housesite patta, has made an application wayback on 03.04.2017 to the third respondent. Thereafter, he has also made a repreentation to the second respondent on 30.05.2017 and again, as later on 09.12.2024. The petitioner has again sought for issuance of free housesite patta in Natham Survey No.163/1, Thiruvaiyathukudi Village, Papanasam Taluk, Thanjore District.

The learned Special Government Pleader appearing for the respondents would invite my attention to the order passed in WP(MD)No.15054 of 2021, dated 06.11.2023 where, in respect of the very same survey number, this Court has directed the Tashildar, Papanasam taluk to deal with the writ petitioner's application therein (W.P(MD)NO.15054 of 2021) and consider the representation and pass final orders, within a period of four weeks. The learned Special Government Pleader would submit that same order can to be passed in the present writ petition.

The learned Special Government Pleader would further submit that this Court in in W.M.P(MD)No.22901 of 2022 in W.P(MD)No. 28919 of 2022 has granted an interim order forbearing the authorities from issuing any patta in the subject survey number, which according to the petitioner therein belongs to Sri Santhanaramaswamy Temple. However, there can be no impediment for the authorities to pass final orders on the petitioner's representation.

Considering all the above circumstances and the eligibility of the petitioner in this survey number or any other survey number, therefore, the writ petition is disposed of directing the third respondent to consider on merits, in accordance with law and dispose of the petitioner's application dated 09.12.2024, within a period of twelve weeks from the date of receipt of a copy of this order.
