ORDER : The Court Made the following order :- The petitioners/A-1 to A-3, who were arrested and remanded to judicial custody on 27.04.2017 for the offences punishable under Sections 392 r/w 397, 419 and 506(ii) of I.P.C in Crime No.695 of 2017 on the file of the respondent police, seek bail. 2.Heard the learned counsel for the petitioners and the learned Government Advocate (Crl. side) appearing for the respondent / Police.
3.The learned counsel for the petitioners would submit that the petitioners are innocent persons and they have nothing to do with the alleged offence and therefore, prays for granting of bail to the petitioners.
4.The learned Government Advocate(Crl. Side) on instructions submitted that the petitioners are said to have acted as police personnel and committed robbery.
5 Considering the facts and circumstances of the case and also considering the fact that the petitioners are in judicial custody from 27.04.2017, this Court is inclined to grant bail to the petitioners. Accordingly, the petitioners are ordered to be released on bail subject to the following conditions: https://hcservices.ecourts.gov.in/hcservices/
(I) Each of the petitioners shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties, each for a like sum to the satisfaction of the learned Judicial Magistrate No.IV, Madurai;
(ii)the petitioners shall report before the respondent police daily at 10.30 a.m., until further orders;
(iii)the petitioners shall not tamper with the evidence or witness either during investigation or trial; (iv) the petitioners shall not abscond either during investigation or trial;
(v)on breach of any of the aforesaid conditions, the Magistrate/Trial Court is entitled to take appropriate action against the petitioners in accordance with law as if the conditions have been imposed and the petitioners released on bail by the Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005) AIR SCW 5560].
