ORDER: The Court made the following order :- The petitioner, who was arrested and remanded to judicial custody on 05.02.2026, for the offences punishable under Sections Sections 8(C)(, 20(B), 25, 29(1) of NDPS Act, in Crime No.130 of 2022, on the file of the respondent police, seek bail.

2.The petitioner said to have committed the above said offences. For the above said offence, the petitioner was arrested and released on bail. Thereafter, the trial was commenced before the trial Court in C.C.No.142 of 2023 on the file of the Special District Court for Communal Clash Cases, Madurai. During the trial process on 21.01.2025, the petitioner was absent, subsequently, it was adjourned to 10.02.2025. On that day also the petitioner was absent. Hence, NBW was issued on 10.02.2025. Thereafter, the petitioner approached this Court by way of anticipatory bail to recall the NBW. This Court, on 22.01.2026, in Crl.O.P.(MD).No.1093 of 2026, directed the accused to appear before the Special Court along with petition to recall the warrant and also directed the Special Court to consider the same on merits. The Special Court dismissed the petition. Hence, the petitioner was arrested on 05.02.2026.

3. The learned counsel for the petitioner submits that the petitioner was unable to appear before the Special Court and file petition to recall the NBW on appropriate time, because of the ill health of the petitioner.

4. The learned Additional Public Prosecutor appearing for the respondent police strongly opposed for grant of bail on the ground that the trial is going on and the case is now posted on 17.03.2026.

5.Considering the special circumstances of the case, this Court is inclined to grant bail to the petitioner on payment of costs. Accordingly, this Criminal Original Petition is allowed on condition that the petitioner shall pay a sum of Rs.5,000/-(Rupees Five Thousand Hundred Only) as non-refundable, to the credit of the Tamil Nadu Police Benevolent Fund, Account No.10232923204, State Bank of India, Triplicane Branch, Chennai, IFSC Code: SBIN0000249, without prejudice to his rights and contentions before the trial Court and produce the receipt / acknowledgment before the learned District and Sessions Judge, Special District Court for Communal Clash Cases, Madurai. 6.On production of receipt / acknowledgement for having paid the amount, the petitioner is ordered to be released on bail, on executing a bond for a sum of Rs.

(b)the petitioner is directed to appear before the trial Court daily on 10.30.a.m. till the conclusion of C.C.No.142 of 2023; (c)the petitioner shall not tamper with evidence or witness; (d)the petitioner shall not abscond during trial; (e)On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560].

(f) If the accused thereafter absconds, a fresh FIR can be registered under Section 269 of BNS.
