RESPONDENTS Petition filed praying that in the circumstances stated therein and in the petition filed therewith the High Court may be pleased to cancel the Anticipatory Bail granted to the 1st ,2nd and 3rd Respondents by this Honble Court dated 29/12/2021 in Crl.OP(MD) No.21093/2021 in respect of case in Crime No.60/2021 on the file of 4th Respondent.
Order : This petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of MR.N.ANANTHAPADMANABHAN, Advocate for M/S.APN LAW ASSOCIATES for the petitioner and of MR.R.GANDHI, Advocate on behalf of the Respondents 1 to 3 and of MR.A.THIRUVADIKUMAR, Additional Public Prosecutor for the 4th Respondent, the court made the following order:- This petition has been filed for cancellation of anticipatory bail granted to the respondent Nos.1 to 3 by Order of this Court, dated 29.12.2021 in Crl.O.P.(MD)No.21093 of 2021 in respect of Crime No.60 of 2021.
2.The learned counsel appearing for the petitioner would submit that after obtaining anticipatory bail, the respondent Nos.1 to 3 have threatened the defacto complainant over phone on 08.03.2022 and hence, she has preferred a complaint against them in Villupuram West Police Station and the same was registered in Crime No.66 of 2022 https://hcservices.ecourts.gov.in/hcservices/ 1/2
CRL MP(MD) No.4800 of 2022 for the offences under Sections 294(b), 323, 341, 506(i) of IPC and Section 4 of Tamilnadu Prohibition of Harassment of Women Act, 2002 and she has also handed over the C.D. of recording voice, dated 08.03.2022.
3.The learned Additional Public Prosecutor appearing for the 4th respondent police would submit that the First Information was registered and case is pending for investigation. The respondent Nos.1 to 3 have complied with the condition regularly by Order of this Court, dated 29.12.2021 in Crl.O.P.(MD)No.21093 of 2021. 4.In view of the foregoing reasons, it is not necessary to cancel the Anticipatory bail granted to the Respondent Nos.1 to 3 by order of this Court dated 29.12.2021 in Crl.O.P.(MD)No.21093 of 2021, regarding Crime No.60 of 2021. The Inspector of Police, Villupuram West Police Station is directed to find out whether the C.D. recorded by the defacto complainant is genuine or not in Crime No.66 of 2022 and proceed the matter in accordance with law. 5.Accordingly, this Criminal Miscellaneous Petition stands dismissed.
