ORDER : The Court Made the following order :- Petitioner / accused prays for grant of anticipatory bail under Section 438 of Cr.P.C. for offences punishable under Sections 294 (b), 323,341, 307, 387 and 506(ii) of IPC in Crime No.211/2016 on the file of respondent police.
2. The case of the prosecution is that the petitioner waylaid the defacto compensation and attacked at his head and robbed a sum of Rs. 2,000/-.
3. The learned counsel for the petitioner submits that the petitioner is innocent and he has not committed any offence as alleged by the prosecution and his name has been falsely implicated in this case.
4. The learned Government Advocate (Crl. Side) submitted that the petitioner is having 2 previous cases and the investigation is pending.
5. On consideration of the facts and circumstances of the case and the submissions made, this Court is of the view that the petitioner can be granted the relief prayed for and accordingly; (a) In the event of arrest by or on appearance before the respondent police;
(b) In the event of appearance before the learned Judicial Magistrate, Thirumangalam, Madurai District, within 15 days from the date of receipt of copy of the order, https://hcservices.ecourts.gov.in/hcservices/
(i) Petitioner shall be enlarged on bail on executing a bond for Rs.10,000/- (Rupees ten thousand only) with two sureties each for the like sum to his satisfaction;
(ii) The petitioner shall stay at Dindigul and report before the Taluk Police Station, daily at 10.30 a.m and 5.00 pm for a period of four weeks and thereafter, he shall be available for interrogation by the respondent police as and when required. sd/- 07/10/2016 / TRUE COPY / Sub-Assistant Registrar (C.S.)
