RESPONDENT/CLAIMANT Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to EXTEND the time granted in C.M.P.(MD) No. 1813 of 2020 in C.M.A (MD) No. 104 of 2020 dated 21.02.2020 for further period of eight weeks and thus render justice.
Prayer in CMA(MD)No.104/2020 :
To set aside the impugned award passed in MCOP. No.661 of 2018 dated 24.4.2019 on the file of the MACT Special District Court Thanjavur.
ORDER : This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/S.P.M.VISHNUVARTHANAN, Advocate for the petitioner, the court made the following order:- This petition is filed to extend the time granted in C.M.P.(MD) No.1813 of 2020 in C.M.A.(MD)No.104 of 2020, dated 21.02.2020.
2. Heard the learned counsel appearing for the petitioner.
3. This Court has already granted interim order in C.M.P.No.1813 of 2020, dated 21.02.2020 and directed the appellant / Tamilnadu State Transport Corporation, to deposit the entire award amount to the credit of Motor Accident Claims Tribunal/ Special District Court, Thanjavur, in M.C.O.P.No.661 of 2018, within a period of eight weeks from the date of receipt of a copy of that https://hcservices.ecourts.gov.in/hcservices/
CMP(MD) No.3294 of 2020 order. Now the appellant / Tamil Nadu State Transport Corporation requests further time to deposit the entire award amount.
4. I am of the view that interim order has been passed even much prior to the announcement of the lock-down period and the reasons stated in the affidavit is not acceptable.
5. In view of the above, this Court is not inclined to extend the time and the Appellant/Tamil Nadu State Transport Corporation is directed to deposit the entire award amount to the credit of Motor Accident Claims Tribunal / Special District Court, Thanjavur, in M.C.O.P.No.661 of 2018, immediately on or before 19.06.2020, failing which, interim order granted by this Court dated 21.02.2020 shall stand automatically vacated without any further reference.
