It is the case of the petitioner that he was appointed as Office Assistant on 16.08.2018 on compassionate grounds, through he was qualified for the post of Driver and possessed all the requisite qualifications. Therefore, the petitioner claims to have been continuously making attempts for securing better post than the post of Officer Assistant and in that process, the petitioner claims to have come to know about certain other persons, who were initially appointed as Office Assistants and thereafter, their cases were considered for promotion to the post of Driver, by relaxing the upper age limit and therefore, the petitioner claims to have submitted a representation dated 23.02.2026 to the respondents requesting for relaxation of upper age limit and for consideration of his case for promotion to the post of Driver. It is also the

case of the petitioner that there are a number of vacancies available in the respondent - Department in the post of Driver and if his case is considered, no prejudice will be caused to anybody. However, complaining non-consideration of the representation dated 23.02.2026, the petitioner has approached this Court by filing the present writ petition.

Mr.Om Prakash, learned Government Advocate, who takes notice for the respondents, through resisted the relief sought in this writ petition, on the ground that the petitioner is claimed to have made reliance on the proceedings of the second respondent, which were issued as early as on 15.05.2014, the same is much prior to his appointment in the respondent - Department and therefore, he cannot claim parity with those persons.

However, taking into consideration the nature of relief sought in this writ petition, which is only for consideration of his representation dated 23.02.2026, which is shown to have been sent to the respondents by way of a registered post, this Court does not see any reason to dwell into the merits of the matter and this Court is of the considered view that it would be in the interest of justice to dispose of this writ petition at the admission stage by directing the first respondent to consider the representation dated 23.02.2026

submitted by the petitioner on it's own merits and pass appropriate orders, within a time limit to be stipulated by this Court.

Accordingly, this writ petition is disposed of by directing the first respondent to consider the representation dated 23.02.2026 submitted by the petitioner on it's own merits and pass appropriate orders, within a period of the three months from the date of receipt of a copy of this order.
