PRAYER IN SA(MD)No. 604 of 2009:

To set aside the judgment and decree passed in A.S.No. 122 of 2005 dated 04.10.2007 on the file of the Sub Court, Sankarankovil reversing the judgment and decree passed in O.S.No. 35 of 2003 dated 09.03.2005 on the file of the Additional District Munsif Court, Sankarankovil and dismiss the suit in O.S.No. 35 of 2003 on the file of the Additional District Munsif Court, Sankarankovil. ORDER : This petition coming up for orders on this day, upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/S.D.NALLATHAMBI, Advocate for the petitioner, the court made the following order:- The petition is filed to condone the delay of 657 days in filing the petition to set aside the abatement caused due to the death of the first respondent in the Appeal.

2. Notice sent to R4 returned with an endorsement 'unclaimed'. Since it is deemed service, print the name of R4 in the cause list. 3.The proposed respondents are served and they are represented by a counsel. Neither counter has been filed nor objection has been raised.

4. Though, the reasons stated in the accompanying affidavit are not satisfactory, in order to give opportunity to the parties to prosecute the appeal on merits, the petition is allowed on condition 2/3

that the petitioners deposit a sum of Rs.6,500/- (Rupees Six Thousand Five Hundred only) before the Registry to the credit of C.M.P.(MD)No.2950 of 2019 in S.A(MD)No.604 of 2009 on or before 13.07.2023, failing which, the petition shall stand automatically dismissed without any further reference to Court.
