O R D E R

This petition is filed seeking to quash the case in Spl.S.C.No.13 of 2020 in Crime No.9 of 2019 on the file of the learned Mahila Court, Thoothukudi.

2.When the matter is taken up for hearing, there is no representation for the petitioner.

3. The learned Additional Public Prosecutor submitted that the petitioner has already moved Crl.O.P(MD)No.3187 of 2020 for quashing the final report, which is sought to be quashed in the present petition. In view of the submission made by the learned Additional Public Prosecutor appearing in that case that there are materials to proceed the case as against the petitioner and at the threshold the criminal proceedings cannot be quashed, this Court dismissed the petition by observing that there is no merit in the quash petition on 24.02.20220. However, this Court was pleased to dispense with the personal appearance of the petitioner with certain conditions.

4. The learned Additional Public Prosecutor submitted that on the side of the prosecution, 21 witnesses have been examined and the case has been posted for defence side evidence. At that stage, this petition came to be filed before this Court.

Crl.O.P.(MD)No.9229 of 2021 be dismissed and suppressing the same this petition appears to be filed, the petitioner deserves no consideration. Hence, this petition is dismissed. Consequently, connected miscellaneous petition is closed.
