To set aside the judgment and decree dated 31.10.2006 in A.S.No.217 of 2006 on the file of 1st Additional Sub Judge, Tirunelveli confirming the judgment and decree dated 17.01.2006 on O.S.No.999/2004 on the file of Principal District Munsif Court, Tirunelveli pending disposal of the second Appeal. ORDER : This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of MR.S.PALANI VELAYUTHAM, Advocate for the petitioners, the court made the following order:- This application has been filed to fix an early date for final disposal of S.A.[MD]No.236 of 2007.

2.As the entire issue revolve around the power of attorney said to be forged, now the document is ordered to be sent for expert opinion by the Criminal Court. This Court is of the view that till such document is returned back, the expert report will have a bearing in deciding this appeal. Therefore, the appeal cannot be disposed without waiting for the documents. Hence, this petition is dismissed.
