ORDER

This Writ Petition has been filed for the issue of a Writ of Mandamus, directing the first respondent to conclude the enquiry that is pending on his file in Na.Ka.No.3568/AA2/2020 within the time frame fixed by this Court.

2.The case of the petitioner is that he is the owner of the subject property and the revenue records also stands in his name, by virtue of a joint patta issued by the Tahsildar, Palayamkottai. According to the petitioner, respondents 3 to 7 executed a power of attorney in favour of the second respondent, even though the property was already purchased by the petitioner and they were aware about the same. The petitioner therefore, gave a complaint to the first respondent on 23.09.2020, to take action against the private respondents. The said complaint was entertained by the first respondent and notice was also issued to the parties to attend the enquiry. W.P.(MD)No.7999 of 2021 respondents did not attend the enquiry and the enquiry is getting adjourned from time to time and therefore, left with no other alternative, the present Writ Petition has been field before this Court seeking for appropriate directions.

3. Heard Mr.A.Srinivasan, learned counsel appearing on behalf of the petitioner and Mr.K.Sathiya Singh, learned Additional Government Pleader appearing on behalf of the first respondent.

4. Taking into consideration the facts and circumstances of the case and also of the fact that the first respondent is already in the process of conducting the enquiry by giving opportunity to the parties, there shall be a direction to the first respondent to complete the enquiry and pass orders strictly in accordance with law, within a period of six (6) weeks from the date of receipt of a copy of this order.

5. This Writ Petition is disposed of with the above directions. No costs.
