The plea of the respondents in the writ appeals and petitioners in writ petitions is that they were temporarily appointed as Sanitary Workers in Town Panchayat and III Grade Municipalities in terms of G.O.Ms.No.199, Municipal Administration and Water Supply Department, dated 12.08.1997 on consolidated pay for a period of three years.
regularisation of their services based on assessment of their performance. In the present case, the respondents in the writ appeals approached the learned Single Judge for the relief of regularisation on completion of three years.
2.The learned Single Judge allowed the writ petitions. Aggrieved by the same, the Executive Officers of the local bodies are on Appeal. In other batch of cases, the petitioners who have not obtained orders as co-employees are also before this Court for the same relief.
3.Since the common questions of law and facts are involved in all these cases, they are taken up together and disposed of by a common judgment.
4.Heard the learned Additional Advocate General assisted by Mr.A.K.Baskarapandian, learned Special Government Pleader and the learned counsel appearing for the respondents and also the learned counsel appearing for the writ petitioners. 5.The substantial issue raised in all the writ appeals and writ petitions was considered by the Division Bench of this Court in W.A.No.1454 of 2007, dated 19.12.2008 in the case of Director of Town Panchayat, Kuralagam, Chennai and two others vs. R.Sundaradas wherein it was held that the writ petitioners therein are entitled to time scale of pay only from the date when they completed three years of service on consolidated pay and not from any subsequent date. The same issue was again considered by the First Bench of this Court in W.A.Nos.
47 and 385 of 2010 in the case of the Executive Officer, (Third Grade Municipality), Palladam vs. C.Kittusamy and others. The relevant portion of the order of the First Bench is extracted hereunder: "2.The short facts leading to the filing of these writ appeals are stated hereunder:- The petitioners in both the writ petitions were appointed as Sweepers/Sanitary Workers by the concerned Town Panchayats, on a consolidated pay of Rs.900/- with effect from 27.03.1998 and 30.04.1998 respectively. They joined duty on different dates in the year 1998. As per the Government Orders, dated 17.08.1999, on completion of three years of service on consolidated pay, they should have been brought under the time scale of pay with effect from the date when they completed three years.
But by means of the orders impugned in the writ petitions, they were brought under the time scale of pay only with effect from 23.02.2006 insofar as W.A.No.47 of 2010 is concerned, and with effect from 23.06.2006 insofar as W.A.No.385 of 2010 is concerned.

3.The learned Single Judge, on the basis of the judgment rendered by a Division Bench of this Court in W.A.No.1454 of 2007, dated 19.12.2008 in the case of Director of Town Panchayat, Kuralagam, Chennai and two others Vs.R.Sundaradas, allowed the writ petitions and held that the writ petitioners are entitled to the time scale of pay only from the date when they completed three years on consolidated pay and not from any subsequent date. Aggrieved by the same, the respective Panchayats have filed the above appeals.
4.We have perused the judgment, dated 19.12.2008 rendered by the Division Bench of this Court in the aforementioned appeal. In our view, as rightly held by the learned Single Judge, the present cases are squarely covered by the said Division Bench judgment. We do not find any reason to differ with the view taken by the learned single Judge. There being no merit in the appeals, they stand dismissed. Consequently, the connected miscellaneous petitions are also dismissed. However, there will be no order as to costs".
6.The said Judgment was taken on Appeal to the Hon'ble Supreme Court by the Executive Officer, Palladam in Special Leave to Appeal (Civil) No.26605/2010 and it was dismissed by an order dated 27.09.2010. Similarly, based on that, several orders came to be passed by learned Single Judges. One such matter was considered by a Division Bench of this Court in W.A.No.283 of 2013 in the case of State of Tamilnadu rep.by Director of Town Panchayats, Kuralgam, Chennai Vs. A.Kalaikumar wherein this Court considered an identical issue of Sanitary Workers and the Division Bench, after distinguishing the Full Bench decision of this Court in S.Dhanasekaran and 24 others Vs. Government of Tamil Nadu rep. by its Secretary, Department of Municipal Administration and Water Supply, Fort.St.George, Chennai - 9 and another, reported in 2013
(6) CTC 593, referring paragraphs 25 and 26 of the said Judgment, upheld the order of the learned Single Judge. Paragraphs 25 and 26 of the Full Bench Judgment cited (supra) are extracted hereunder:- "25.So far as the judgment of the Division Bench in W.A.Nos.47 and 385 of 2010 is concerned, there , the Sweepers/Sanitary Workers, working in Town Panchayats, claimed benefit of G.O.Ms.No.199, Municipal Administration and Water Supply Department, dated 12.08.1997. In that case, the Division Bench had no occasion to consider the scope of G.O.Ms.Nos.101, 71 and 21, Municipal Administration and Water Supply Department, dated 30.04.1997, 05.05.1998 and 23.02.2006 respectively. It needs to be mentioned that the judgment in W.A.Nos.47 and
385 of 2010 was challenged before the Supreme Court by way of SLP and the SLP was dismissed as its threshold by the Hon'ble Supreme Court. Though the fact remains so, the said judgment in W.A.Nos.47 and 385 of 2010 has got nothing to do with the issues relating to the regulation of the Sanitary Workers working in Municipalities and Municipal Corporations. As we have already pointed out, the above judgment relates to sweepers and sanitary workers working in panchayats, who were governed by different Government Orders.
26.The judgment in W.A(MD)No.729 of 2013 relates to the sanitary workers working in Municipalities. But, the Division Bench had considered only G.O.Ms.No.199, Municipal Administration and Water Supply Department, dated 12.08.1997 and not the G.O.Ms.Nos.101, 71, and 21, Municipal Administration and Water Supply Department dated 30.04.1997, 05.05.1998 and 23.02.2006, respectively. So far as G.O.Ms.No.199, Municipal Administration and Water Supply Department, dated 12.08.1997 is concerned, the said G.O has got nothing to do with the sanitary workers employed on consolidated pay in municipalities and Municipal Corporations. There were only six categories of employees for whose benefit G.O.Ms.No.199, dated 12.08.1997 was issued. They are Sanitary Inspector, Sanitary Maistry, Sweeper, Cross Pool Cleaner, Compose Mazdoor and Drainage Cleaner. Therefore, in our considered view, the said G.O.Ms.No.199, Municipal Administration and Water Supply Department, dated 12.08.1997, cannot be made applicable to the Sanitary Workers working in Municipalities/Municipal Corporations...."
7.We find that the decision in the case of State of Tamil Nadu and others Vs. A.Kalaikumar was also subject matter of Special Leave Petition, which was dismissed on 30.03.2015 and recorded by the Division Bench of this Court in the case of the Secretary to Government of Tamil Nadu, Municipal Administration & Water Supply Department, Fort St.George, Chennai -9 & Others Vs. M.Rani reported in (2015 - 3 - L.W.614). Paragraph - 23 of the said order reads as follows:
"23.Yet again, a Division Bench of this Court, in the State of Tamil Nadu and 2 others Vs.A.Kalaikumar, on the same issue, by judgment dated 12.03.2014, confirmed the order of the learned single Judge. Thereagainst, a Special Leave Petition being SLP (C)No.19006 of 2014 was preferred by the State which was dismissed on 30.03.2015". 8.The Division Bench in Rani's case also referred to the decisions of Sundaradas's case and C.Kittusamy's case (supra) at paragraphs 21 and 22 of its order which read as follows:
"21.A Division Bench of this Court in Sundaradas (supra), while examining the identical issue in respect of regularisation of employees who were appointed under G.O.Ms.Nos.199 and 84 of the Municipal Administration and Water Supply Department dated 12.08.1997 and 21.05.1998 respectively, after completion of three years of their service, upheld the order passed by the learned single Judge, wherein, it was held that the respondents have completed three years of service and the authorities have appraised their services and on being satisfied, recommended the case to the respondents for regularisation. Thus, they were held as entitled to regularisation after three years.
22.Relying on the aforesaid judgment dated 19.12.2008, a Division Bench of this Court in C.Kittusamy (supra), dismissed the appeals on 23.06.2010, upholding the order of the learned single Judge for regularisation after three years. It is informed that the Special Leave Petition preferred thereagainst has been dismissed at the admission stage itself. Thus, in all the writ petitions filed subsequently by other similarly placed employees, similar order of regularisation after three years with consequential benefits was passed.
9.The finding of the Rani's case (supra) reads as follows:
"27 As we have observed in the preceding paragraphs, the respondents were informed at the time of their appointment that their appointment was on consolidated pay, subject to pay enhancement by 10% every year initially for a period of one year at a time, subject to renewal on assessment/review after a period of three years. It was also indicated to the respondents that their cases may be considered for regularisation on assessment of their performance. Thus, it is not a case of appointment on consolidated pay or daily wages simplicitor. Albeit appointment was of temporary nature, however, that was subject to regular assessment and probable regularisation on completion of three years. Thus, the respondents are not entitled to regularisation on completion of three years automatically, without consideration of their performance. On assessment/review, if it is found that their performance is satisfactory, they are entitled to be granted time scale on regular basis.
28.We are not delving into other questions, viz., res judicata and also regularisation of ad hoc/daily wage employees, as the same are not relevant and necessary in
the contextual background of the facts involved in these cases. Thus, we are not referring to and discussing all the decisions cited by the learned counsel appearing for the parties on different issues, which are not germane for adjudication of the issue involved herein.
29.Resultantly, for the reasoning and analysis made hereinabove, the appeals are partly allowed to the extent that the respondents are entitled to consideration for grant of time scale on regular basis on the basis of performance assessment to be done on completion of three years and in the event, the performance of the respondents, is found satisfactory, they are entitled to regularisation on completion of three years, with all consequential monetary benefits. Costs made easy. Connected Miscellaneous Petitions are closed. 10.
We find no reason to make any distinction in the present case, in view of various orders passed by the Division Bench and dismissal of the department appeals by the Hon'ble Supreme Court, except to point out that in terms of the order of the Division Bench in Rani's case (supra), the need for assessment before regularisation is a condition precedent. It is not the case of all the respondents in the writ appeals and the writ petitioners that they should be regularised without assessment. 11.Be that as it may, in view of the various decisions passed by the Division Bench, we find no reason to interfere with the orders of the learned Single Judge and the case of Rani's case (supra) does not make any difference insofar as the relief granted to the petitioners. The procedure prescribed under G.O.Ms.No.
199, Municipal Administration and Water Supply Department, dated 12.08.1997, requires to be followed.
12.In the result, the writ appeals are dismissed and the writ petitions are allowed. The impugned orders passed by the respective respondents are set aside. No costs. Connected Miscellaneous Petitions are closed.
