ORDER

This petition has been filed seeking for a direction to the respondents 1 and 2 to initiate necessary action against respondents 5 and 6 as per the dictum laid down by the Hon'ble Supreme Court of India in Lalitha Kumari -vsGovernment of Uttar Pradesh and others reported in 2014 (2) SCC 1 within the time stipulated by this Court.

2. The learned counsel for the petitioner submitted that the petitioner herein is the Allopathy Doctor, who is serving as Block Medical Officer in the Primary Health Centre at Rajapalayam, Virudhunagar, who is also a 2/6

transgender, having suffered sexual abuse from one Saravanan, who is a multipurpose hospital worker. He had earlier lodged a complaint before the 3rd respondent police, pursuant to which an FIR in Crime No.37 of 2025 came to be registered as against the said Saravanan. Even thereafter, the petitioner is continuously being subjected to harassment. In this regard, the petitioner had given another complaint, for which the respondents 5 and 6 have not taken any proper criminal action. Hence, this petition came to be filed.

3. The learned Government Advocate appearing for the respondents 1 to 4 and 7 submitted that the submission made by the learned counsel for the petitioner is not fully correct. It is true that earlier complaint was lodged against the said Saravanan and promptly, an FIR in Crime No.32 of 2025 was registered on 05.02.2025 by the fourth respondent police, pursuant to which, Saravanan, who is a multi purpose worker, was terminated from the service of the Primary Health Centre at Rajapalayam, Virudhunagar. Thereafter, he had also availed anticipatory bail in the said crime. In the interregnum, both the petitioner as well as the said Saravanan had lodged cross complaints against each other. In this regard, the Additional Superintendent of Police, Virudhunagar District had already commenced enquiry, wherein the petitioner also appeared and the same is pending.

4. Heard the learned counsel on either side and carefully perused the materials available on record. Considering the nature of the order proposed to be passed against the respondents 5 and 6, who are the police officials, impleaded in their personal capacity, notice to them is dispensed with.

In view of the rival submissions made on behalf of the respective parties, and also considering the fact that the case is now pending enquiry before the Additional Deputy Superintendent of Police, Virudhunagar District, the Additional Deputy Superintendent of Police, Virudhunagar District, is suo motu impleaded as the 7th respondent, for whom, Mr.M.Sakthi Kumar, learned Government Advocate takes notice. Registry is directed to carry out necessary amendment.

In view of the fact that the enquiry has already been commenced, wherein the petitioner also appeared and the same is now pending before the 7th respondent, this Court directs the 7th respondent to conclude the enquiry as expeditiously as possible within a period of two weeks from the date of receipt of copy of this order, and the second respondent is also directed to monitor the same.
