ORDER

This Petition is filed to condone the delay of 165 days in filing the above Civil Miscellaneous Appeal.

2. Heard the learned counsel appearing for the petitioner and perused the materials placed before this Court.

3. Though notice was served on the Respondent No.3, none appears for the respondent No.3 either in person or through counsel. The respondent No.3 called absent and set exparte. The Respondent Nos.1 & 2 are concerned, their name printed in the cause list.

4. For the reasons assigned in the accompanying affidavit and on being satisfied with the same, this Petition is ordered and the delay of 165 days in filing the above Civil Miscellaneous Appeal is condoned. 2/3

5. Registry is directed to number the Civil Miscellaneous Appeal, if the papers are otherwise in order.
