PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Certiorarified Mandamus, to call for the records pertaining to the 2nd Respondent impugned proceedings in Ka.No.U.Mi.Po/E & Pe/Kooma/Ko.Kattu/A.No.373/2025 dated 17.09.2025 quash the same as illegal and arbitrary and consequently, to direct the Respondent to provide the electricity connection to the petitioner's temple namely Arulmigu Ammachiyar Amman which is situated in Survey No. 609 Government Poramboku at 15th Ward S.Kodikulam Town Panchayat Koomapatti, Virudhunagar District within the time limit that may be stipulated by this Court. O R D E R

The petitioner is before this Court assailing the proceedings dated 17.09.2025 issued by the second respondent.

2. By the said proceedings, the petitioner's application seeking electricity service connection to the temple, namely, Arulmigu Ammachiyar Amman Temple, situated in Survey No. 609 (Government 2/6

poramboke land) at 15th Ward, S. Kodikulam Town Panchayat, Koomapatti, Virudhunagar District, came to be rejected.

3. Admittedly, the temple is situated on Government poramboke land. However, no steps have been taken by the competent authority to remove the encroachment, and it is not in dispute that the temple is in existence on the said land.

4. Mr. S. Deenadhayalan, learned counsel appearing for respondents 1 and 2, submitted that the petitioner's application would be considered afresh on its merits within a time frame to be stipulated by this Court.

5. In view of the above, the writ petition is disposed of, and the impugned order passed by the second respondent in Ka.No. U.Mi.Po/E & Pe/Kooma/Ko.Kattu/A.No.373/2025 dated 17.09.2025 is hereby quashed. The second respondent is directed to consider the petitioner's representation dated 16.10.2025 on its own merits and pass appropriate orders in accordance with law. The respondents shall provide electricity 3/6

service connection in the name of Arulmigu Ammachiyar Amman Temple, subject to the petitioner furnishing an indemnity bond and an undertaking letter, and subject to the petitioner satisfying all other eligibility criteria.

6. It is made clear that the provision of electricity service connection shall not confer any right upon the petitioner, nor shall it preclude the competent authority from taking action to remove the encroachment in accordance with law.

7. There shall be no order as to costs. Consequently, the connected miscellaneous petition is closed.
