PRAYER: Criminal Original Petition filed under Section 482 Cr.P.C. praying to set aside the order transferring the inquiry or investigation on the complaint of the petitioner to the third respondent herein, issued by the second respondent in R.C.No.C3/885/012936/2016 dated 30.07.2016 and consequently, to direct the second respondent to register the complaint dated 12.07.2016 preferred by the petitioner for the offence punishable under Sections 65, 66, 74 and 85 of Information Technoloy Act, 2000 and 419, 465, 468 and 420 IPC in accordance with law. ORDER

This Criminal Original Petition has been filed, for a direction to register the complaint dated 12.07.2016 preferred by

the petitioner for various offences under the Information Technology Act, 2000 and also for various offences under the Indian Penal Code.

2.After the receipt of the complaint by the third respondent, the same was forwarded to the second respondent, by letter dated 20.09.2016 and the same is pending on the file of the second respondent.

3.The learned counsel appearing for the petitioner would submit that since the matter is to be investigated by a specialized cell, which is well-versed with cyber crime, the second respondent has to allot the case to the specialized agency available in CBCID.

4.In the facts and circumstances of the case, the second respondent is directed to allot the case to the cyber crime cell in CBCID and proceed in accordance with law strictly, within a period of four weeks from the date of receipt of a copy of this order.

5.This Criminal Original Petition is disposed of, with the above direction.
