ORDER : The Court Made the following order :- The petitioner, who was arrested and remanded to judicial custody on 08.02.2017, for the offences punishable under Sections 8(c) r/w 20 (b)(ii)(c) & 25 of NDPS Act, in Crime No.25 of 2017, on the file of the respondent Police, seeks bail.

2.Heard Mr.M.Jegadeesh Pandian, learned counsel appearing for the petitioner and Mr.K.Anbarasan, learned Government Advocate (Criminal Side) appearing for the State.

3.The case of the prosecution is that on 08.02.2017, the petitioner was found in possession of 60 Kgs., of Ganja. 4.The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has not committed any such offence as alleged by the prosecution.

5.The learned Government Advocate appearing for the State strongly objected to grant bail to the petitioner. 6.Taking into consideration the facts and circumstances of this case, considering the gravity of offence said to have been committed by the petitioner and also the period of incarceration, this Court is of the view that this is a fit case to grant bail to the petitioner. Accordingly, he is ordered to be released on bail, subject to the following conditions:

(i) the petitioner shall execute a bond for a sum of Rs.10,000/- (Rupees ten thousand only) with two sureties each for a like sum to the satisfaction of the Principal Special Court for EC and NDPS https://hcservices.ecourts.gov.in/hcservices/

(ii) the petitioner shall report before the respondent police daily at 10.30 a.m., until further orders.

(iii) the petitioner shall not tamper with evidence or witness either during investigation or trial.

(iv) the petitioner shall not abscond either during investigation or trial.

(v) On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560].
