PRAYER: Criminal Original Petition filed under Section 482 of Cr.P.C, praying to direct the learned Judicial Magistrate Court, Tirumangalam, Madurai District to proceed the case in PRC No.03/2022 on the file of the Learned Judicial Magistrate Court, Tirumangalam, Madurai Disrict expeditiously and dispose the case within a time frame fixed by this Court. The petitioner is an accused in Crime No.160 of 2021. The petitioner has approached this Court for a direction to the trial Court to commit the case in P.R.C.No.03 of 2022, which is pending on the file of the learned Judicial Magistrate, Thirumangalam.

2.The learned Government Advocate (Crl.Side) submits that a nonbailable warrant is pending against the petitioner. 3.According to the learned Counsel appearing for the petitioner, the petitioner was convicted in another case in C.C.No.365 of 2021, on the file of the II Additional Special Court for NDPS Act Cases, Madurai and therefore, he was imprisoned at the relevant point of time. Instead of summoning the petitioner from the judicial custody, non-bailable warrant has been issued. The petitioner has not purposely evaded from appearing before the trial Court.

4.This Court considered the rival submission made. 5.This petition is disposed of with a direction to the learned Judicial Magistrate to issue a P.T.Warrant to the petitioner's appearance, who is now confined at Central Prison, Madurai and commit the case in P.R.C.No.3 of 2022, within a period of four weeks, from the date of receipt of a copy of this order.
