... Respondents Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, to call for the records relating to the cancellation order dated 13.12.2023 passed in the petitioners application reference No.200050031123782 dated 29.11.2023 for a new domestic residential service connection and quash the same and consequently, direct the 2nd respondent to provide new domestic residential service connection to the house bearing Door No.23 situated at Pillaiyar Kovil Street, Goripalayam, Madurai by taking in to consideration of other co-owners consent within the time stipulated by this Court. 1/4

For Petitioner : Mr.K.Arunraj For Respondents : Mr.S.Deenadhayalan

ORDER

Heard the learned counsel on either side.

2. The petitioner has constructed a tiled house. It is on their patta land. The petitioner is also having undivided share therein. The petitioner is having a special girl child aged about 23 years. The petitioner has given a representation to the second respondent seeking electricity connection for the same. The second respondent has not complied with the petitioner's request only because, the other co-sharers have not given their consent. It appears that the property originally belongs to one Rakkammal. She is the petitioner's grandmother. She is no more. There are at present seven legal heirs. It is seen that the other legal heirs are also residing in the very same survey number. When they are enjoying the electricity connection, it would be unjust to deprive the petitioner's service connection also. The respondent is directed to provide independent service connection to the petitioner forthwith and without any delay subject to fulfilment of other usual formalities. 2/4

3. The Writ Petition is allowed. No costs. Consequently, connected miscellaneous petition is closed.
