ORDER : The Court made the following order :- Heard the learned counsel appearing for the petitioner and the learned Government Advocate(Criminal Side) appearing for the respondent.
2. The petitioner apprehending arrest at the hands of the respondent police for the offences punishable under sections 294(b), 323 and 506(ii) of IPC., in Crime No.not known of 2020, on the file of the respondent police, seeks anticipatory bail.
3. The case of the prosecution is that in Nazareth Cathedral, Priest-in-charge was transfered and a new Priest took charge. The https://hcservices.ecourts.gov.in/hcservices/
CRL OP(MD).No.6263 of 2020 petitioner and his supporters received the new Priest, which was opposed by the de facto complainant and his supporters. On the receiving function, the de facto complainant and his supporters created chaos which was questioned by the petitioner and this led to a wordy quarrel between the two groups. Hence, the complaint.
4. The learned counsel appearing for the petitioner would submit that the petitioner received new Priest and on the Church politics, the other group preferred this false complaint as against the petitioner and the petitioner is an innocent. Hence, the learned counsel prays for grant of anticipatory bail in favour of the petitioner.
5. The learned Government Advocate(Criminal side) appearing for the State would submit that the petition enquiry is pending against the petitioner.
6. In the view of the above submission made by the learned Government Advocate (Criminal side), the respondent police is directed to conduct the enquiry and if any prima facie case is made out against the petitioner, the respondent police shall register the F.I.R or close the petition enquiry within a period of two weeks from the date of receipt of a copy of this order.
