ORDER : The Court Made the following order :- The petitioners are arrayed as accused Nos.1 and 2, who were surrendered before the learned Judicial Magistrate on 14.07.2016 and remanded to judicial custody on the same day for the alleged offences punishable under Section 174 Cr.P.C altered into Sections 364, 302 and 201 IPC, in Crime No.158 of 2016, on the file of the respondent police and hence, seek bail.

2.The prosecution case is that the accused and deceased are working in dance troop. Due to illicit intimacy between the first accused and the deceased, all the accused joined together and kidnapped her on 08.07.2016 and subsequently, strangulated her to death.

3.The learned counsel for the petitioners submitted that the petitioners are innocent persons and they have been falsely implicated in this case and they are languishing in jail for more than 90 days.

4.The learned Government Advocate (Criminal Side) submitted that on 26.09.2016, the respondent, after completing investigation, filed final report and the petitioners had no bad antecedents. https://hcservices.ecourts.gov.in/hcservices/

5.Considering the submission of the learned counsel for the petitioners and the learned Government Advocate (Criminal Side), this Court is inclined to grant bail to the petitioners.

6. Accordingly, the petitioners are directed to be released on bail, on each of them executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Pudukkottai and on further condition that the petitioners shall reside at Trichirappalli and appear before the Cantonment Police Station daily twice at 10.00 a.m., and 05.00 p.m., until further orders. sd/- 14/10/2016 / TRUE COPY / Sub-Assistant Registrar (C.S.)
