O R D E R

The petitioner is before this Court seeking issuance of a Writ of Mandamus directing the first respondent to fix a fair rent and collect the same by considering the petitioner's representation dated 10.09.2025.

2. The petitioner is running a milk parlour situated on the roadside within the limits of the Madurai Corporation, subject to payment of licence fee. The first respondent had earlier initiated action to evict the petitioner, which compelled the petitioner to approach this Court by filing W.P. (MD) No.26806 of 2025. This Court, by order dated 25.10.2025, set aside the show cause notice issued by the first respondent, while granting liberty to the first respondent to issue a fresh show cause notice and proceed further after affording an opportunity of personal hearing to the petitioner. As on date, no fresh show cause notice has been issued by the first respondent. In the meanwhile, the petitioner submitted a representation requesting the first respondent to fix a fair rent for the premises and collect the same. However, the said representation has not been considered, which has necessitated the filing of the present writ 2/4

petition.

3. Heard the learned counsel appearing on either side and perused the materials available on record.

4. Admittedly, the petitioner is running a milk parlour on the roadside land belonging to the first respondent. In such circumstances, the first respondent is obliged to consider the representation submitted by the petitioner.

5. Accordingly, this Writ Petition stands disposed of with a direction to the first respondent to consider the petitioner's representation dated 10.09.2025 on its own merits and pass appropriate orders in accordance with law within a period of four weeks from the date of receipt of a copy of this order. No costs.
