For Respondent : Mr.K.Dinesh Babu, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No. 1376/2020 on the file of the respondent police.
ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 147, 148 and 302 IPC in Crime No.1376 of 2020, seeks anticipatory bail.
2.The case of the prosecution is that on 04.11.2020 at about 04.00 pm., the defacto complainant, who is the Village Administrative Officer, Palanchur Group found that one Anthony died with cut injuries. Hence, the complaint.
3.The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has been implicated on the basis of the confession of the co-accused. He further submitted that there is no overt act against the petitioner. Therefore, he seeks for anticipatory bail to the petitioner. https://hcservices.ecourts.gov.in/hcservices/
4.The learned Government Advocate(Crl.side) submitted that because of abscondence of this petitioner, the investigation in this case could not be completed and therefore, he opposed this petition. 5.Considering the fact that it is a murder case and the fact that due to the abscondence of this petitioner, investigation could not be completed, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this criminal original petition is dismissed.
