ORDER : The Court Made the following order :- The petitioner is arrayed as accused No.4, who was arrested and remanded to judicial custody on 28.09.2016 for the alleged offence punishable under Sections 147, 148, 294(b), 323, 324 and 307 IPC in Crime No.697 of 2016, on the file of the respondent police and hence, seeks bail.
2.The case of the prosecution is that on 28.09.2016, due to money transaction between the petitioner and the defacto complainant, the petitioner along with other accused attacked him with sword and caused injuries.
3.The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case and he is languishing in jail from 28.09.2016. 4.The learned Government Advocate (Criminal Side) would submit that injured person had already been discharged from the hospital and no previous case is pending against the petitioner and coaccused was granted anticipatory bail by this Court in Crl.O.P(MD) No.19089 of 2016.
5.Considering the submission of the learned counsel for the petitioner and the learned Government Advocate (Criminal Side), this Court is inclined to grant bail to the petitioner. https://hcservices.ecourts.gov.in/hcservices/
6. Accordingly, the petitioner is directed to be released on bail, on executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.II, Ramnad District and on further condition that the petitioner shall appear before the respondent police daily at 10.00 a.m., until further orders.
