This petition has been filed seeking to direct the respondent to transfer the patta in respect of the property comprised in New Survey No. 118/2A4, Kandadevi Village, Kandadevi Group, Devakottai Taluk, Sivagangai District, measuring an extent of 20.50 cents, in his favour by considering the petitioner's representation dated 27.02.2026.
2. The learned counsel for the petitioner submitted that one A.N. Gandhi Ramasamy had executed a registered power of attorney on 13.09.2010 in favour of S.P. Sudha, authorizing her to deal with and alienate the subject property. Subsequently, on 28.02.2025, the said A.N. Gandhi Ramasamy, represented by his power of attorney agent S.P. Sudha, executed a registered sale deed in favour of the petitioner for valid and valuable consideration. Hence, the petitioner seeks transfer of patta in his name.
3. The learned Special Government Pleader appearing for the respondent submitted that the power of attorney executed by A.N. Gandhi Ramasamy is 2/5
invalid. It was further stated that A.N. Gandhi Ramasamy had raised objections on 24.09.2025, and in light of these circumstances, the power of attorney was cancelled. Consequently, the alleged sale deed executed thereafter is rendered illegal. Therefore, the petitioner is not entitled to the relief sought in the petition.
4. Considering the facts and circumstances of the case, the alleged sale deed executed by S.P. Sudha is rendered invalid, as the power of attorney had already been cancelled. However, liberty is granted to the petitioner to approach the competent court in accordance with law.
