O R D E R

This writ petition has been filed by the petitioner to direct the 1st respondent to consider the petitioner's representation dated 24.02.2025 and to provide adequate police protection to fence his lands in S.F.No.434 and 421, which are situated at Pothuravuthanpatti Village, Krishnarayapuram Taluk, Karur District.

2. According to the petitioner, he is the owner of the property in S.F.Nos. 434 and 421, which are situated at Pothuravuthanpatti Village, Krishnarayapuram Taluk. While so, the private respondents no. 2 and 3 have caused disturbance to the possession of the petitioner and already they have surveyed the property and fixed the boundary stones. For surveying the land, he already obtained an order from this Court for police protection and the same was also allowed. Now, when the petitioner attempted to create fence over the property the private respondents are causing disturbance and they are resisting the petitioner from creating fence. Therefore, he sent a representation dated 24.02.2025 for providing adequate police protection for fencing the property, but the same has not been considered. Hence this petition.

The learned Additional Public Prosecutor (Criminal Side) appearing for the first respondents would submit that there is a dispute in respect of the properties and thereby, already the petitioner surveyed the land through this Court order and the police protection was also given to survey the land. Now, the petitioner want to fence the property. The said representation of the petitioner is under consideration and they will dispose of the same within a week.

Since the prayer of the petitioner is to consider the representation of the petitioner dated 24.02.2025 and the same is also admitted by the first respondent, it is for the 1st respondent to dispose of the same in accordance with law. In view of the same, this Court direct the 1st respondent to dispose the representation of petitioner dated 24.02.2025 in accordance with law by affording opportunities to both the parties within a period of fifteen [15] days from the date of this order.

5. With the above said observations and directions, this writ petition is disposed of. No costs.
