For Respondent : M/s.M.Anandha Devi, Government Advocate (Criminal Side) PETITION FOR ANTICIPATORY BAIL Under Section 438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No. 99 of 2021 on the file of the respondent police.

ORDER : The Court made the following order :- The petitioner, who is arrayed as Accused, apprehending arrest at the hands of the respondent police for the offences punishable under Sections 452, 354(B) and 506(i) of IPC, in Crime No.99 of 2021 on the file of the respondent police, seeks anticipatory bail. 2.The case of the prosecution is that on 05.04.2021, at about 02.00 p.m the petitioner said to have criminally trespassed into the defacto complainant's house and sexually assaulted the defacto complainant's second daughter namely, Nanthini and teared her nighty and threatened her. At that time, when the victim girl cried, the defacto complainant came there. Thereafter, the petitioner escaped from the scene of occurrence. Hence, the present complaint. 3.Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Criminal Side) appearing for the respondent.

CRL OP(MD). No.5418 of 2021 that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. He further submitted that the petitioner is not having any bad antecedent. Hence, he prayed for grant of anticipatory bail to the petitioner.

5.The learned Government Advocate (Criminal Side) appearing for the respondent police submitted that the allegation against the petitioner is serious in nature and that the petitioner is having one previous case and that the investigation is at crucial stage. 6.Considering the nature of the offence lodged against the petitioner is serious in nature and also considering the fact that the petitioner is having one previous case and the fact that the investigation is at initial stage, this Court is not inclined to grant anticipatory bail to the petitioner.

7.Accordingly, this Criminal Original petition stands dismissed.
