ORDER
The present contempt petition has been filed alleging violation of the interim order passed by this Court dated 17.12.2024, made in W.P(MD)No. 16652 of 2024, wherein the respondent Bank was directed to pay subsistence allowance to the petitioner upto the date of compulsory retirement, if it is not already disbursed.
2.The present contempt petitioner has been filed alleging that a sum of Rs.4,32,529/- was credited to the bank account of the petitioner and they started deducting interest for the said amount. Therefore, the said amount is only treated as loan by the respondent Bank and the subsistence allowance has not been paid as per the directions of this Court. 3.The learned Counsel appearing for the Bank has submitted that the petitioner is maintaining two accounts. One is the staff overdraft account and another one is the savings bank account. These two accounts were frozen on the instructions of the Central Bureau of Investigation. The petitioner has approached this Court for defreezing these accounts. After the order of this Court, both the accounts were defreezed. The subsistence allowance that was 2/4
credited to the staff overdraft account was debited from the said account and credited to the savings bank account of the petitioner on 12.04.2024. Therefore, the amount that was credited to the petitioner savings bank account on 12.04.2024, namely, Rs.4,32,529/- represents the subsistence allowance of the writ petitioner. The said amount would never be treated as a loan. This submission of the learned Counsel appearing for the respondent Bank is hereby recorded.
