PRAYER:- Civil Revision Petition filed under Article 227 of the Constitution of India to dispose of the RCOP.No.13 of 2009 on the file of Rent Controller Cum District Munsif Court, Thanjavur, within a time stipulated by this Court.

ORDER

This revision has been filed seeking a direction to dispose of RCOP.No.13 of 2009 on the file of Rent Controller Cum District Munsif Court, Thanjavur, within the specified time fixed by this Court.

2. I have heard the learned counsel appearing for the petitioner. Since the revision petition is filed for early disposal of the case, issuance of notice to the respondent is not necessary.

3. It is evident from the records that the revision petitioner has filed the petition in RCOP.No. 13 of 2009 against the respondent for fixation of fair rent. It is further evident that the case stands posted for respondent side evidence on 18.03.2021. The proceedings under the Rent Control Act are summary in nature. But, the case on hand is pending for the past more than 11 years.

4. The High Court has already sent Circulars to the District Judiciary directing the Courts to give priority for the disposal of old cases, more particularly, more than seven years old cases.

5. Considering the fact that RCOP is of the year 2009 and 11 years have already been lapsed, this Court is inclined to give https://hcservices.ecourts.gov.in/hcservices/ 1/2

C.R.P(MD).No. 716 of 2021 a direction to the learned Rent Controller - Cum - District Munsif, Thanjavur, for early disposal. Accordingly, the learned Rent Controller - Cum - District Munsif, Thanjavur, is directed to expedite the trial and dispose of the case in RCOP.No.13 of 2009 pending on its file, within a period of three months from the date of receipt of a copy of this order, on merits and in accordance with law.

6. With the above direction, this Civil Revision Petition is disposed of. No costs.
