ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offence punishable under Sections 294(b) 323 and 506(i) of IPC and Section 4 of Women Harassment Act, in Crime No.557 of 2017, on the file of the respondent police, seeks anticipatory bail.
2.Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondent/State.
3.The case of the prosecution is that there are three accused in this crime number. The petitioner/A3 and the defacto complainant are neighbours and on 24.05.2017, due to wordy quarrel, the petitioner with other accused persons assaulted the defacto complainant with hands and used filthy language and also threatened her with dire consequences.
4.The learned counsel for the petitioner submitted that due to previous enmity the petitioner has been falsely implicated in this case. A1 and A2 are already arrested and released on bail and this petitioner is A3. She is no way connected to the occurrence. https://hcservices.ecourts.gov.in/hcservices/
5. Considering the facts and circumstances of the case and also considering the fact that the co-accused were released on bail, this
Court is inclined to grant anticipatory bail to the petitioner, with certain conditions. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate, Melur, Madurai District and on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police as and when required for interrogation. The petitioner shall comply with the condition stipulated under Section 438 Cr.P.C. scrupulously. 6.The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed.
