ORDER : The Court Made the following order :- The petitioner is arrayed as accused No.2, who was arrested and remanded to judicial custody on 23.09.2016 for the alleged offence punishable under Sections 8 (c) r/w 20(b)(ii)(C) & 25 of NDPS Act, in Crime No.4 of 2014, on the file of the respondent police and hence, seeks bail.

2.The case of the prosecution is that when the respondent was conducting vehicle check, the petitioner was found in possession of 22 kgs of ganja.

3.The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case and he is languishing in jail from 23.09.2016. The coaccused A1 and A2 were granted bail by this Court in Crl.O.P(MD) Nos.16792 of 2014 and 4486 of 2014.

4.The learned Government Advocate (Criminal Side) would submit that charge-sheet has already been filed and the same has been taken on file in C.C.No.122 of 2014 and co-accused were granted bail by this Court.

5.Considering the submission of the learned counsel for the petitioner and the learned Government Advocate (Criminal Side), this Court is inclined to grant bail to the petitioner. https://hcservices.ecourts.gov.in/hcservices/

6. Accordingly, the petitioner is directed to be released on bail, on executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Additional District Judge for Special Court for EC and NDPS Act Cases, Madurai and on further condition that the petitioner shall appear before the respondent police daily at 10.00 a.m., until further orders.
