ORDER

The present petition has been filed for issuance of Writ of Mandamus directing the respondents herein to consider and dispose of the representation, dated 25.10.2023.

2. According to the petitioner, there is a dispute between the petitioner and one Kanthasamy, son of Kanthsamy, namely, Ramesh, Balamurugan and one Saravanan in respect of property. Thereby, on 22.10.2023, Kanthasamy and his son, Ramesh, Balamurugan and one Saravanan trespassed into the property of the petitioner and removed the tailoring machines worth about Rs.2,00,000/- and also taken Rs.78,000/- and thereby, he sent a complaint before the second respondent on 25.10.2023 but the same has not been considered and thereafter, he sent a representation, dated 09.11.2023 through registered post but no action was taken by the second respondent. Therefore, the petitioner filed this petition.

3. The learned Additional Public Prosecutor appearing for the respondents would submit that the representation of the petitioner, dated 2/5

25.10.2023 was already considered and the same was closed as money dispute pending between the parties. Therefore, nothing survives for further adjudication in the present case. Today, the copy of the report also furnished to the petitioner.

4. Since the prayer of the petitioner is to consider the representation of the petitioner, dated 25.10.2023 and the same was already closed as money dispute, it is for the petitioner to challenge the same in the manner known to law, if he is aggrieved.

5. Therefore, preserving the liberty of the petitioner to challenge the closure report in the manner known to law, this writ petition stands closed. There shall be no order as to costs.
