Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, directing the 3rd respondent to survey and demarcate the property in Survey No.185/C1A1, Na. Vallundanpattu Village, Thanjavur District, as per the registered release deed dated 14.02.2024 and further direct the 4th respondent to provide adequate police protection to the petitioner and the revenue officials to conduct the said survey and to subsequently enable the petitioner to erect a fence / compound wall around the legally demarcated property.

O R D E R

This petition has been filed seeking to direct the 3rd respondent to survey and demarcate the property in Survey No.185/C1A1, Na. Vallundanpattu 2/7

Village, Thanjavur District, as per the registered release deed dated 14.02.2024 and further direct the 4th respondent to provide adequate police protection to the petitioner and the revenue officials to conduct the said survey and to subsequently enable the petitioner to erect a fence / compound wall around the legally demarcated property.

2. The learned counsel for the petitioner submitted that the petitioner purchased the property under Document No. 515 dated 14.02.2024 and subsequently effected mutation in the revenue records. When the petitioner attempted to fence the property, the 5th respondent, an unknown person, objected to such action. Therefore, the petitioner seeks to have the property surveyed, demarcated, and fenced. In this regard, the petitioner submitted a representation dated 21.03.2025 and also filed an online application on 12.03.2025 after paying the requisite fees.

3. The learned Special Government Pleader appearing for respondents 1 to 3 submitted that the 5th respondent has raised an objection. 3/7

4. Considering the facts and circumstances of the case, this Court directs the 3rd respondent to conduct the survey after issuing notice to the petitioner as well as the 5th respondent. If necessary, seek police protection, the 4th respondent shall provide police protection to survey the land. The Court is also directing the Official respondents to adhere to the following Standard Operating Procedures: a. The Official respondents shall issue notice to the petitioner immediately reaching the spot where survey is to be conducted. The petitioner shall affix the signature by receiving the notice of survey.

b. After survey again the petitioner shall affix signature indicating that the survey was conducted to their satisfaction.

c. If the petitioner is not satisfied, then also the petitioner shall affix signature indicating their dissatisfaction or with protest. The petitioner shall indicate that reason of their dissatisfaction or protest. The aforesaid procedure shall be strictly followed by the parties The said exercise 4/7

shall be completed within a period of 12 weeks from the date of receipt of a copy of this order.
