ORDER

(Order of the Court was made by N. ANAND VENKATESH,J.) This Habeas Corpus Petition has been filed by the mother of the detenue seeking for a direction to the respondents to produce the body or person of the detenue and to set her at liberty,

2. Heard the learned counsel on either side.

3. The case of the petitioner is that her daughter had completed 12th standard at Chennai and had moved to Madurai for pursuing higher studies in Madura College. Thereafter, the detenue returned back to Chennai and was employed in a Company. At that point of time, she has eloped with the third respondent, who is a married man.

4. The further case of the petitioner is that from 21.07.2025, the whereabouts of the detenue was not able to be ascertained and in spite of the best efforts, the detenue was not able to be traced. The third respondent was also missing. Their mobile phones were also switched off. Under such circumstances, the petitioner's sister gave a complaint before the second respondent on 22.07.2025, based on which, 'a woman missing FIR' was registered in Crime No.440 of 2025.

5. The grievance of the petitioner is that till date, the detenue has not been traced by the second respondent and it is under these circumstances, the present Habeas Corpus Petition came to be filed before this Court.

The learned Additional Public Prosecutor appearing for the respondent Nos.1 and 2, on instructions, submitted that the detenue developed a love relationship with the third respondent, who is also a married man and both the detenue as well the third respondent have eloped and their mobile phones are also switched off. Hence, the second respondent is taking all efforts to trace the whereabouts of the detenu.

Taking into consideration the facts and circumstances of the case and the submissions made by the learned Additional Public Prosecutor, there shall be a direction to the second respondent to trace the whereabouts of the detenue and the third respondent expeditiously and produce them before the learned Judicial Magistrate No.V, Madurai. The learned Judicial Magistrate shall record the statement of the detenue and proceed further in accordance with law. A report shall also be submitted before this Court.
