ORDER : The Court Made the following order :- The petitioner, who is arrested and remanded to judicial custody on 27.04.2018 for the alleged offences punishable under Sections 8[c] r/w.20(b)(ii) (c) and 25 C of NDPS Act in Crime No.85 of 2018 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner is found in possession of 78 kgs of Ganja and hence, the case has been registered.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and a false case has been foisted against them and there is no previous case.

4. The learned Government Advocate (Criminal side) submitted that the petitioner is found in possession of 78 Kgs of Ganja. However, he opposed to grant bail to the petitioner.

5. Considering the facts and circumstances of the case and also taking note of the period of incarceration of the petitioner, I am of the view that the petitioner could be enlarged on bail. Accordingly, it is ordered that the petitioner shall be released on bail, on executing a separate bond for a sum of Rs.10,000/- (Rupees https://hcservices.ecourts.gov.in/hcservices/

Ten Thousand only)each, with two sureties each for a like sum to the satisfaction of the learned Special Judge for EC and NDPS Act cases, Madurai, and on further condition that the petitioner shall report before the Court concerned daily twice at 10.30 a.m. and 5.00 p.m., until further orders.
