ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 324 and 332 of IPC., read with Section 3(1) of TNPPDL Act, in Crime No.136 of 2017, on the file of the respondent police, seeks anticipatory bail.

2.Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor for the respondent/State. 3.The case of the prosecution is that on 16.05.2017, due to quarrel between A1, A2 and the defacto complainant at the time of bus strike, A1 attacked the defacto complainant using stone. 4.The learned counsel for the petitioner submitted that due to bus strike there was a quarrel between the accused persons and the defacto complainant. The petitioner is the driver of the TNSTC bus and on the confession of the accused, the petitioner was falsely implicated in this case. A1 was already released on bail and A2 was enlarged on anticipatory bail. The petitioner is no way connected with the alleged occurrence.

5.Considering the facts and circumstances of the case, this Court is inclined to grant anticipatory bail to the petitioner, with certain conditions. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before https://hcservices.ecourts.gov.in/hcservices/

the learned Judicial Magistrate, Aranthangi, and on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police and when required for interrogation. The petitioner shall comply with the condition stipulated under Section 438 Cr.P.C. Scrupulously. 6.The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed.
